Terms of Service
Effective May 7, 2026
These Terms of Service ("Terms") govern your use of OpsDesk and getopsdesk.com (the "Service"), provided by OpsDesk ("OpsDesk," "we"). By creating an account or using the Service, you agree to these Terms.
1. Accounts
You must provide accurate information and keep your credentials confidential. You're responsible for activity under your account. Workspace owners are responsible for managing their team's access.
2. Subscriptions and billing
- Paid plans are billed in advance on a monthly or annual basis.
- Trials convert to paid plans on the date stated at signup unless cancelled.
- Fees are non-refundable except where required by law.
- We may change pricing with at least 30 days' notice before your next renewal.
3. Your content
You retain ownership of operational data and content you upload ("Customer Data"). You grant OpsDesk a limited license to host, process, and display Customer Data solely to provide the Service.
4. Acceptable use
You agree to follow our Acceptable Use Policy. We may suspend accounts that violate it.
5. Service availability
We work to keep the Service available but do not guarantee uninterrupted access. Scheduled maintenance and outages may occur.
6. Third-party integrations
The Service may integrate with third-party tools. Your use of those tools is subject to their terms. OpsDesk is not responsible for third-party services.
7. Termination
- You may cancel anytime from workspace settings or by emailing support@getopsdesk.com.
- We may suspend or terminate accounts for non-payment, abuse, or violation of these Terms.
- On termination, you may export data for 30 days; afterward we may delete it.
8. Disclaimer
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OPSDESK'S TOTAL LIABILITY ARISING FROM OR RELATED TO THE SERVICE WILL NOT EXCEED THE FEES YOU PAID IN THE 12 MONTHS BEFORE THE CLAIM. OPSDESK IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR DATA.
10. Indemnification
You agree to indemnify and hold OpsDesk harmless from claims arising out of your Customer Data or your violation of these Terms.
11. Governing law
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws rules. Disputes will be resolved exclusively in state or federal courts located in Delaware.
12. Changes
We may update these Terms; continued use after changes means acceptance.
